Definitions

Guided tour

A guided tour refers to a walking or cycling tour through Bruges or its surroundings, as listed on the website, with a specified duration. It can also be a custom-made guided tour ordered by the customer and organized by S-wan vzw.

Booking

A guided tour ordered by the customer becomes a confirmed booking once a guide is available for the tour and the customer receives electronic confirmation that the order will be executed.

Rescheduling

Any changes to the subject, date, time, or number of participants in a booked tour must be re-planned by the dispatch team.

Force majeure

Force majeure is a juristic term referring to to unforeseen and unavoidable circumstances preventing the fulfillment of obligations, such as natural disasters (earthquake, snowstorm, flooding…), epidemics and pandemics, wars, or technical failures. To legally qualify as force majeure, the event must be unpredictable, beyond the party’s control, and make fulfillment impossible

To legally qualify as force majeure, the situation must meet the following conditions:

  • It involves an unforeseeable event (at the time of concluding the agreement),
  • The event cannot be attributed to the party invoking it,
  • It makes the fulfillment of the obligation by that party impossible.

In such cases, it is assumed that “no one is obliged to achieve the impossible.”

Agreement and order process

The agreement involves the booking by the customer of one or more guided tours offered by S-wan vzw .

Customers can book a tour via:

  • the website (Regiondo)
  • contacting S-wan vzw via email

After ordering, the customer receives an email confirmation once a guide is found for the execution of his tour, making the order an official booking. S-wan vzw pledges to execute the booking once a guide is found.

Duration and end of the engagement

Tours start at the agreed-upon time and location, with a duration as listed on the website.

Number of participants

A tour typically has a maximum of 20 participants unless stated otherwise. If this number is exceeded, additional guides must be booked.

Payment terms

The price for a tour is listed on the website and applies to groups of up to 20 participants.

Payment methods include:

  • Online payment through the website (Regiondo)
  • Cash, bank transfer, or invoice for bookings made via email.

If the customer doesn’t order through the website (Regiondo), he is asked to clarify the method of payment in his order.

Prices on the website are in Euros. Payments are always in Euros.

S-wan vzw is not VAT-liable.

Cancellation & Modification Fees

Cancellation within 5 days before the tour incurs a 30% fee.

Cancellation on the day of the tour or no-show incurs a 100% fee.

If S-wan vzw is in the impossibility to execute the guided tour due to force majeure, it reserves the right to cancel the agreement without any claim for compensation. The full amount will be refunded.

If the customer cancels due to force majeure, a 10% administrative fee applies.

Booking modifications do not incur penalties, but if the group exceeds the participant limit, an extra guide must be booked.

Intellectual Property

The structure, content, and branding of the tours and website are protected by intellectual property rights. Personal data processing follows the privacy and cookies policy available on the website.

Miscellaneous

Guides are insured via the Federation of Tour Guide Associations.

Amendment of the General Terms and Conditions

These general terms and conditions are subject to change and may be unilaterally modified by S-wan vzw.

Applicable law and competent courts.

Belgian law applies to this site. In case of a dispute, only the courts of the district of Bruges have jurisdiction.pledge
