This message will always be sent to the customer electronically. <\/p><p><u>Rebooking<\/u><\/p><p>Any change to the subject, date, time or number of participants of the tour booked by the customer must be rescheduled by dispatching.<\/p><p><u>Force majeure<\/u><\/p><p>Force majeure is a legal concept referring to a situation in which a person is unable to fulfil their obligations due to unforeseen and unavoidable circumstances. This may be caused, for example, by a natural disaster (earthquake, snowstorm, flooding, \u2026), epidemic or pandemic, war, unforeseen technical failures or defects that prevent performance, or other external factors beyond the control of the person or party involved.  <\/p><p>To qualify as force majeure under the law, the situation must meet the following conditions:<\/p><ul><li>It concerns an unforeseeable event (at the moment the agreement is concluded),<\/li><li>that cannot be attributed to the party invoking it,<\/li><li>which makes it impossible for the same party to fulfil the obligation.<\/li><\/ul><p>In such cases, it is assumed that \u201cno one is obliged to do the impossible\u201d.<\/p><p><strong>Subject of the agreement \/ how the agreement is concluded<\/strong><\/p><p>This agreement relates to the booking by the customer of one or more guided tours organised and offered by S\u2011WAN.<\/p><p>The customer can order a tour in two ways:<\/p><ul><li>directly via the website (Regiondo)<\/li><li>by contacting S\u2011WAN by email<\/li><\/ul><p>Following the submission of an order, the customer will receive an electronic confirmation by e-mail. Upon receipt of this confirmation, the order shall be deemed a confirmed booking. S\u2011WAN undertakes to fulfil the booking accordingly. <\/p><p><strong>Duration and termination of the agreement<\/strong><\/p><p>The guided tour will commence at the location and time agreed between S\u2011WAN and the customer and will last for the duration specified for that tour on the website.<br\/><\/p><p><strong>Number of participants<\/strong><\/p><p>A guided tour accommodates a maximum of 20 participants, unless otherwise specified in the tour information on the website. If the number of participants exceeds 20 (or the maximum stated in the tour information on the website), the customer must book a second (and, if necessary, a third, fourth, \u2026) guide. <\/p><p><strong>Payment terms<\/strong><\/p><p>The price of the tour is stated in the tour information on the website. The price always applies to a group of up to 20 participants (unless otherwise specified in the tour information). The only exception is the price for the Maandtoerke (only Dutch spoken) which is listed per person, as customers can register individually.  <\/p><p>The customer may choose one of the following payment methods:<\/p><ul><li>for bookings made online through the website (Regiondo\/Enviso), payment must be completed at the time of booking via the website&#8217;s payment portal.<\/li><\/ul><ul><li>in cash, by bank transfer, or by invoice if the customer makes a booking by email.<\/li><\/ul><p>for bookings not made via the website (Regiondo\/Enviso), the customer must indicate and confirm the chosen payment method as part of the booking process.<\/p><p>The prices on the website are listed in euros. Payment is always made in euros. <\/p><p>S\u2011WAN is exempt from VAT and does not charge VAT on its services. <\/p><p><strong>Cancellation and modification fees<\/strong><\/p><p>In the event of a cancellation less than 5 days before the scheduled tour, the customer owes a fixed compensation amounting to 30% of the value of the booking.<\/p><p>In the event of a cancellation on the day of the tour itself, or in case of a no\u2011show, the customer owes a fixed compensation amounting to 100% of the value of the booking.<\/p><p>If, due to force majeure, we are unable to carry out the assignment, we reserve the right to terminate the agreement without any compensation being owed. Any amount already paid will be refunded in full. <\/p><p>If the customer is unable to participate in the booked tour due to force majeure, any amount already paid will be refunded, subject to a 10% administrative fee.<\/p><p>If the customer requests a modification of the booking (such as a change of date or time) and S\u2011WAN is required to reschedule the tour, no administrative or cancellation fee shall be charged. However, where the modification causes the group size to exceed the maximum number of participants specified in the tour details on the website, an additional guide shall be required and charged accordingly. <\/p><p><strong>Intellectual property<\/strong><\/p><p>The form, content and performance of the guided tours, as well as all content available on this website, including trademarks, logos, designs, data, product and company names, texts, images and other materials, are protected by intellectual property rights and remain the property of S\u2011WAN or the respective third-party rights holders.<\/p><p><strong>Processing of personal data<\/strong><\/p><p>The privacy and cookies policy can be found on the page \u201cDisclaimer, privacy &#038; cookies policy\u201d on this website.<\/p><p><strong>Miscellaneous<\/strong><\/p><p>Our guides are insured for civil liability through the Federation of Tourist Guide Associations (vzw).<\/p><p><strong>Amendments to the general terms and conditions<\/strong><\/p><p>These General Terms and Conditions are subject to change and may be amended unilaterally by S\u2011WAN at any time. Any amended version shall replace all previous versions from the date of publication.<\/p><p><strong>Applicable law and competent courts.<\/strong><\/p><p>Belgian law applies to this site.
